Terms of Use

These Terms of Use ("Terms") govern access to craftywand.com and the CraftyWand browser-based packaging design service, including its model library, 3D Studio, dieline editor, project storage, exports and related tools (collectively, the "Service"). By creating an account, buying a plan or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and authority

You must be at least 18 years old, or the age of legal majority where you live, to create an account or purchase a plan. If you use the Service for a business or another organization, you confirm that you have authority to accept these Terms for that organization.

2. Accounts and session security

You must provide accurate account information and keep your credentials and devices secure. Your account is personal to you unless a separate team arrangement is offered. You are responsible for activity performed through your account. Contact [email protected] promptly if you suspect unauthorized access.

3. The Service and available plans

CraftyWand provides browser tools for choosing packaging structures, viewing 3D mockups, editing dielines and artwork, saving eligible projects, and exporting supported files. The currently available non-AI tools are provided free to registered users without a subscription purchase. Pro AI is coming soon and is not currently available.

We may improve, add, retire or replace features, and may introduce or change plans, prices, limits or access requirements in the future. Any applicable price and recurring billing terms will be presented before a purchase.

4. Your content and ownership

You retain ownership of artwork, images, logos, text, project data and other content you upload or create through the Service ("Your Content"). You grant CraftyWand a limited, non-exclusive license to host, copy, transform, render and display Your Content only as needed to operate the Service for you, such as stripping image metadata, saving a project, generating a preview or preparing an export.

You confirm that you have the rights and permissions required for Your Content and that its use does not violate intellectual property, privacy, publicity or other rights.

5. Private projects and prohibited account access

Private projects and uploads are associated with the verified account that owns them. You must not guess identifiers, alter requests, reuse another person's link or otherwise attempt to open, copy, change or delete another user's private project, account or upload. Denied attempts may be recorded for security review and may result in suspension or termination.

Authorized CraftyWand personnel may inspect private project content when reasonably necessary to answer a support request, investigate a security or policy concern, comply with law or protect the Service. Such access is restricted, read-only by default and recorded with the administrator, target project, time and stated reason.

6. Acceptable use

You may not use the Service to violate law or third-party rights; distribute malware or harmful code; interfere with Service operation; evade plan limits or watermarks; scrape or automate access in a way that burdens the Service; probe accounts or infrastructure without written authorization; reverse engineer protected parts of the Service except where law expressly permits it; or resell the Service without written permission.

7. CraftyWand content and intellectual property

The Service software, interface, branding, structural models, templates and documentation are owned by CraftyWand or its licensors and are protected by intellectual property laws. Your account or plan grants a limited, revocable, non-transferable right to use the Service under these Terms. It does not transfer ownership of the Service or permit use of the CraftyWand name or logo as your own.

8. Subscriptions, payment and taxes

Paid subscriptions are processed through Stripe. You authorize the charges presented at checkout, including recurring charges for the selected billing period until cancellation. Prices may exclude taxes, which may be added where required. You are responsible for applicable taxes and for keeping payment information current. Except where applicable law requires otherwise, fees already charged are non-refundable.

9. Cancellation and plan changes

You may cancel or change an eligible plan through the available account or billing flow. Cancellation normally prevents a future renewal and does not undo the period already purchased. When a paid entitlement ends, paid features and limits may stop immediately or at the end of the applicable billing period. Access to saved work may be limited by the rules of the remaining plan, so export or retain any files you need before the change takes effect.

10. AI-assisted features

The CraftyWand AI assistant is not fully released. Inspiration images, previews and future AI-assisted output are drafts and may contain errors, unsuitable content, inaccurate text or unexpected similarities. You remain responsible for reviewing spelling, brand accuracy, legal copy, claims, intellectual property, barcodes and print requirements before use or production.

11. Print and production review

3D previews, dielines and exports are design tools, not a substitute for printer approval, material testing or a physical proof. Before production, verify dimensions, folds, glue areas, bleed, safe areas, color requirements, text, codes and the printer's technical specifications. You are responsible for approving the final production file.

12. Third-party services

The Service uses third-party infrastructure, payment, email and content-delivery providers and may link to third-party sites. Their services may be governed by separate terms. CraftyWand is not responsible for third-party content or a third party's independent acts, but will use providers as described in the Privacy Policy.

13. Disclaimers

To the extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted availability, that every suggestion or export is error-free, or that a file will satisfy every printer or legal requirement. Consumer rights that cannot lawfully be excluded remain unaffected.

14. Limitation of liability

To the maximum extent permitted by law, CraftyWand will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, business, opportunity or data, arising from the Service. Where liability cannot be excluded, total liability relating to the Service will not exceed the amount you paid to CraftyWand during the twelve months before the event giving rise to the claim. This limit does not apply where applicable law prohibits it.

15. Suspension and termination

You may stop using the Service at any time. We may restrict, suspend or terminate access when reasonably necessary to address a Terms breach, payment failure, security risk, unlawful use or harm to the Service or another user. Terms concerning ownership, payment obligations, disclaimers, liability and other provisions that should survive will continue after termination.

16. Changes, applicable law and contact

We may update these Terms as the Service changes. Material updates will be identified by a new date and additional notice where required. These Terms are governed by applicable law, including mandatory consumer protections that apply where you live. The registered-entity and governing-jurisdiction details should be added when finalized by the business owner.
